Nantucket Court Report
A status review hearing for William H. Constable, 52, formerly of C St. in Madaket, on Oct. 14 charges of possession of marijuana and five counts of possession of child pornography, was continued to June 9. According to Assistant District Attorney Thomas Shack, the Commonwealth needs more time to review the case to determine if Constable will be indicted locally. Constable recently pleaded guilty in federal court and is awaiting sentencing. Jerry Todd Daub, 55, of 1 Skyline Drive, was assigned an April 9 date for a jury trial on Sept. 9, 2007 charges of operating a motor vehicle under the influence of alcohol and failing to slow. A pretrial hearing for Edward Clifford Durell, 63, of 7 1/2 Meeting House Lane, on Feb. 8 charges of operating a motor vehicle under the influence of alcohol, unlicensed operation of a motor vehicle, speeding and a marked lanes violation, was continued to March 31. A hearing for Matthew Geade, 22, of Killington, Vt., on Sept. 5, 2007 charges of operating a motor vehicle under the influence of alcohol and a marked lanes violation, was continued to May 19 for a jury trial assignment. A hearing for Donald Garnett, 49, of 5 Beaver St., on Oct. 15, 2007 charges of forgery of a check, uttering a false check and larceny under $250 from a disabled person, was continued to May 19 for jury trial assignment. Kerica Hendricks, 22, of 9 Point Judith Lane, was arraigned on Feb. 15 charges of assault and battery and had the case continued to March 31. A hearing for Matthew S. Holt, 31, of New York, N.Y., on Sept. 2, 2007 charges of operating a motor vehicle under the influence of alcohol and a motor vehicle by-law violation, was continued to May 19 for jury trial assignment. Martynas Ivaskevicius, 21, of 11 Essex Road, had March 13 charges of unlicensed operation of a motor vehicle, not having an inspection sticker, a miscellaneous motor vehicle equipment violation and furnishing a false name, dismissed on payment of $400 in court costs. A hearing for Trevor P. Johnson, 48, of 7 Daffodil Lane, on Nov. 2, 2007 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, a marked lanes violation and possession of an open container of alcohol in a vehicle, was continued to May 19 for jury trial assignment. A hearing for Patrick S. Keating, 41, of 68 Orange Street, on Aug. 21, 2007 charges of operating a motor vehicle under the influence of alcohol, was continued to May 19 for jury trial assignment. A hearing for Lance J. Kiarsis, 29, of 9 Bayberry Lane, on Oct. 20, 2007 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, leaving the scene of an accident with property damage and speeding, was continue to May 19 for jury trial assignment. A hearing for Meredith Laine, 35, of Norwell, Mass., on July 8, 2007 charges of operating a motor vehicle under the influence of alcohol and a motor vehicle by-law violation, was continued to May 19 for jury trial assignment. Sophia Liburd, 39, of 9B Point Judith Lane, was arraigned on March 15 charges of assault and battery and was ordered to return to court on March 31. A hearing for Eugene Mahon, 61, of 23 Skyline Drive, on Jan. 12 charges of operating a motor vehicle under the influence of alcohol, a motor vehicle lights violation and an improper turn, was continued to May 19 for jury trial assignment. Stephen Maury, 23, of 0 Main St., was arraigned on March 14 charges of operating a motor vehicle under the influence of alcohol and unlicensed operation of a motor vehicle and had the case continued to March 31. William J. McCarthy, 53, of 7A Forest Ave., was assigned an April 8 date for a jury trial on May 26, 2007 charges of operating a motor vehicle under the influence of alcohol and speeding. Larry Mote, 51, formerly of Nantucket, admitted to sufficient facts in three cases pending against him and was ordered to serve 90 days in the Barnstable House of Corrections. The cases were March 8, 2007 charges of armed assault in a dwelling, assault and battery and assault and battery with a dangerous weapon; an Aug. 5, 2007 charges of possession of a firearm with out a federal ID card and Oct. 2, 2007 charges of operating a motor vehicle with a suspended license, operating a motor vehicle with a suspended registration and operating an uninsured motor vehicle. David Mowles, 37, of 3 Oakland St., was assigned an April 7 jury trial date on Jan. 31 charges of operating a motor vehicle with a suspended license, operating a motor vehicle with a suspended registration and operating an uninsured motor vehicle. A hearing for Seth R. Moyer, 32, of 23 Broadway, on a July 7, 2007 charge of operating a motor vehicle under the influence of alcohol, was continued to May 19 for jury trial assignment. Elizabeth Murphy, 22, of Wellesley, Mass., was assigned an April 7 jury trial date for April 25, 2007 charges of operating a motor vehicle under the influence of alcohol and a motor vehicle by-law violation. James O'Brien, 25, of 25 Nobadeer Farm Road, had a Sept. 16, 2007 charge of trespassing dismissed after paying all court costs. A hearing for Ryan O'Conner, 31, of 2B Massasoit Bridge Road, on Sept. 9, 2007 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle and speeding, was continued to May 19 for jury trial assignment. Charles R. Pearl, 34, of 36 Sparks Ave., had Jan. 1, 1999 charges of indecent assault and battery on a child under 14 and statutory rape of a child dismissed after serving probation and paying all court costs. A hearing for Neil E. Racicot, 34, of Brimfield, Mass., on Oct. 19, 2007 charges of operating a motor vehicle under the influence of alcohol, and a marked lanes violation was continued to May 19 for jury trial assignment. A hearing for Kennedy P. Richardson, 22, of 25 Low Beach Road, on June 16, 2007 charges of operating a motor vehicle under the influence of alcohol and a marked lanes violation, was continued to May 19 for jury trial assignment. Hector Rivas, 38, of 68 Hooper Farm Road, was assigned an April 9 jury trial date for Jan. 20 charges of operating a motor vehicle under the influence of alcohol, unlicensed operation of a motor vehicle and a marked lanes violation. Edwin Ruiz, 35, of Brockton, Mass., was assigned an April 7 jury trial date on Dec. 7, 2007 charges of forgery of a Registry of Motor Vehicles document and not having a license in his possession. James W. Simmons, 27, of South Shore Road, was assigned an April 9 jury trial date on June 13, 2007 charges of operating a motor vehicle under the influence of alcohol, improper operation of a motor vehicle, and failing to wear a seatbelt. Ryan Oswell Small, 20, of 12 Daffodil Lane, was arraigned on March 15 charges of operating a motor vehicle under the influence of alcohol, possession of liquor by a person under 21 and a motor vehicle lights violation, and was ordered back to court on April 22. A hearing for Adam Michael Stiener, 40, of Winston-Salem, N.C., on June 26, 2007 charges of operating a motor vehicle under the influence of alcohol and possession of a class B drug, was continued to May 19 for jury trial assignment. A hearing for Martin Subocz, 27, of Warwick, N.Y., on Aug. 31, 2007 charges of operating a motor vehicle under the influence of alcohol and failing to drive in the right lane, was continued to May 19 for jury trial assignment. A hearing for Nigel Timms, 46, of 1A Harbor Square, on Sept. 7 charges of operating a motor vehicle under the influence of alcohol, a marked lanes violation and failing to wear a seat belt, was continued to May 19 for jury trial assignment. A hearing for Robert E. Todd, 47, of Franklin, Mass., on Oct. 17, 2007 charges of operating a motor vehicle under the influence of alcohol, and failing to stop or yield, was continued to May 19 for jury trial assignment. A hearing for Timothy A. Trudel, 23, of 11 Mizzenmast, on Oct. 13, 2007 charges of operating a motor vehicle under the influence of alcohol, possession of an open container of alcohol in a motor vehicle and a marked lanes violation, was continued to May 19 for jury trial assignment. Daniel William Twomey, 26, of Benjamin Drive, had his probation extended on May 20, 2007 charges of breaking and entering during the day time for a felony and wanton destruction of property, so that he may have more time to pay court costs. Glen Scott White, 43, of 9 Allen's Way, was assigned an April 8 trial date on May 31, 2007 charges of operating a motor vehicle with a suspended license and failure to yield at an intersection. Fred E. Wilson, 39, of 3B Cynthia Lane, was granted a motion for a new trial stemming from Sept. 20, 2007 charges of possession with intent to distribute a class D drug, operating a motor vehicle with a suspended license and a motor vehicle lights violation.
