FEDS TAKE PEDOPHILE INTO CUSTODY

Pre-trial hearings for islander William H. Constable, 53, of 7 C Street in Madaket, recently charged with child pornography, were continued in Nantucket District Court on Monday to Dec. 10 because Constable is currently in federal custody in Plymouth. Officials said if he is released from custody he will have to wear an electronic ankle bracelet that will monitor his whereabouts at all times.

Constable was initially arrested in Barnstable on October 20 after Hyannis hotel employees found his digital camera containing scenes of sex with children. After his home was searched and more material was found, he was charged with five counts of possessing child pornography and one count of marijuana possession. He posted $25,000 bail and was released on personal recognizance last Tuesday by Nantucket District Court Judge Joseph Macy with the condition that he wear an electronic monitor and return for Monday's conferences. On Thursday, Oct. 25, however, he was arrested at his Nantucket home on a federal criminal complaint charging him with producing child pornography outside the United States and transporting the material into this country.

A search of Constable's island residence turned up multiple DVDs, video cassettes, photos and other materials depicting him engaged in sexual activities with young girls as well as photos of other men having sex with children. All are believed, at this point, to have been taken in Asian countries and no known incidences are believed to have occurred between Constable and children in the U.S., including Nantucket.

Constable's case, under investigation by the FBI and Barnstable and Nantucket police, is being prosecuted by Assistant United States Attorney Dana Gershengorn and attorney Elizabeth M. Yusi of the Child Exploitation and Obscenity Section of the Department of Justice Criminal Division, according to information from the U.S. Attorney's Office.

Jose Almeida, 41, of 35 Macy Lane, charged July 23 with driving without a license and equipment violations.

A warrant issued for Ronaldo J. Alvarenga, 30, of 5 Hull Lane, charged Oct. 11 with driving with a suspended license.

A warrant issued for Oscar Amaya, 48, of 9 Wampanoag Way, charged July 13 with driving an uninsured vehicle.

The case against Laurent P. Araujo, 26, of 2 Pine Tree Road, charged Sept. 4 with assault and battery, was dismissed.

The case against Michael K. Araujo, of 40 Hooper Farm Road, charged with breaking and entering in the day to commit a felony and vandalizing property, was continued to Nov. 19.

Colin W. Bixby, 21, of 24B Sconset Road, charged Oct. 2 with driving under the influence of alcohol and failing to stop, was continued to Dec. 4.

The case against Jason J. Brady, of Nantucket, charged Aug. 3, 2006 with drug distribution, was continued to Nov. 19.

Kathleen A. Brosnan, 49, of 8 Witherspoon Drive, charged July 16 with driving an uninsured, unregistered vehicle, will have the case dismissed with $50 court costs.

Javier Campos, 21, of 48 Hooper Farm Road, charged Oct. 27 with resisting arrest, will have the charge dismissed with $50 court costs. A charge of disorderly conduct was dismissed.

Vincent Cilfone, 26, of 10 Bassett Road, charged July 18 with drug possession, had his case continued to Nov. 19.

Joel P. Coelho, 44, of Hyannis, Mass., charged April 2 with driving an uninsured vehicle with a suspended registration, had his case continued to Nov. 19.

David E. Connolly, 50, of 14 Union St., charged Sept. 26 with drug possession, had his case continued to Nov. 19.

Maria N. Costanzo, 44, of 25 Daffodil Lane, charged May 28, 2006 with driving under the influence of alcohol, paid due costs and had her case dismissed.

A warrant issued for Cordel A. Crump, 25, of 13 Pine Grove Drive, charged July 31 with driving without a license and speeding.

Jerry T. Daub, 51, of 1 Skyline Drive, charged Sept. 24 with driving under the influence of alcohol and failing to slow, had his case continued to Dec. 10.

Matthew Gaede, 22, of Killington, Vt., charged Sept. 15 with driving under the influence of alcohol and driving outside lanes, had his case continued to Nov. 13.

Donald A. Garnett, 48, of 5 Beaver St., charged Oct. 15 with check forgery, check uttering and larceny under $250 from someone over 60, had his case continued to Dec. 10.

Jacques N. Gauvin, 28, of 11 Meader St., charged Sept. 22 with driving under the influence of alcohol, negligent driving, failing to stop for police, speeding, driving outside lanes, failing to stop, slow, signal or wear a seat belt, had his case continued to Dec. 10.

Eric Gilston, 19, of Greenland, N.H., charged Aug. 10 with driving under the influence of alcohol, negligent driving and driving outside lanes, admitted to driving under the influence and had the case continued one year without a finding. He must take the driver alcohol program and had his license suspended for 210 days. Negligent driving was dismissed and he was found not responsible on the lanes charge.

Kimberly S. Hardy, 25, of 37 Tashama Lane, charged Sept. 6 with driving under the influence of alcohol and a license plate violation, had her case continued to Nov. 13.

Michelle A. Harrison, 18, of 37 Somerset Road, charged June 2 with drug possession, driving outside lanes and not wearing a seat belt, paid due costs and had her case dismissed.

Kevin D. Holdgate, 35, of 50 Old South Road, charged Sept. 7, 2006 with distributing cocaine and conspiracy to violate the drug law and on Dec. 22, 2006 with cocaine distribution, had his case continued to Nov. 13.

James W. Kelley, 47, of Dennisport, Mass., charged Aug. 7, 2005 with assault and battery with a dangerous weapon and resisting arrest, had his probation terminated.

Lance Kiarsis, 29, of 9 Bayberry Lane, charged Oct. 20 with driving under the influence of alcohol, negligent driving and leaving the scene of property damage, had his case continued to Dec. 10.

Karen Y. Kozlowski, 44, of 27 West Sankaty Road, charged on various dates in 2006 and 2007 with assault and battery with a dangerous weapon, driving an uninsured vehicle with a suspended registration, driving with a suspended license and shoplifting, still owes the court more than $1,000 and had her cases continued to Jan. 28 for payment review.

Edgar J. Leinbergs, 50, of 5 Catherine Lane, charged Oct. 13 with violation of a restraining order, had his case continued to Nov. 5.

Meghan L. Malloy, 23, of Cumberland, R.I., charged Oct. 2 with driving under the influence of alcohol, driving outside lanes and driving with no license in possession, had her case continued to Nov. 13.

John M. Mayo, 25, of 12 Longwood Drive, charged Aug. 29 with six counts of vandalizing property, had his case continued to Dec. 10.

Linda L. McDonough, 61, of 315 Milestone Road, charged July 17 with driving with a suspended license, will have the charge dismissed with $50 court costs.

Andra Moore, of Nantucket, charged with assault and battery with a dangerous weapon, had the case dismissed.

Christopher J. Murphy, 60, of 211 Hummock Pond Road, charged Oct. 25 with driving under the influence of alcohol and outside marked lanes, admitted to driving under the influence and had the case continued one year without a finding. He must take the driver alcohol program and had his license suspended for 45 days. He was found not responsible on the lanes charge.

Rosny Noguera, 26, of 167 Orange St., charged Oct. 27 with driving without a license, will have the charge dismissed with $100 court costs.

Cody H. Peterson, 22, of 4 Bayberry Court, charged Oct. 27 with driving under the influence of alcohol, leaving the scene of property damage and negligent driving, had his case continued to Nov. 19.

Ronald J. Phillips, 40, of 20 Seikinnow Place, charged Sept. 9, 2005 with breaking and entering in the night to commit a felony and larceny under $250, had his case continued to Dec. 10.

David S. Pike, 27, of Nantucket, charged on various dates in 2006 and 2007 with drug possession, driving an uninsured vehicle with a suspended license and registration, and another charge of drug possession and driving with a suspended license, had his cases, including a charge of probation violation, continued to Dec. 10.

Roxanna E. Pimental, 27, of 3B Boynton Lane, charged Sept. 23 with driving under the influence of alcohol and outside marked lanes, had her case continued to Dec. 10.

Christen J. Pires, 32, of Wareham, Mass., charged Oct. 27 with resisting arrest and disorderly conduct, had his case continued to Nov. 19.

Peter A. Puglisi, 32, of Wappingers Falls, N.Y., charged Oct. 27 with assault and battery, had his case continued to Dec. 17.

Neil E. Racicot, 34, of Brimfield, Mass., charged Oct. 19 with driving under the influence of alcohol and outside lanes and on Oct. 24 with driving with a suspended license, had his cases continued to Nov. 19.

Mark J. Roche, 52, of Nantucket, charged Nov. 13, 1992 with assault and battery and on Jan. 21, 1993 with violating an abuse prevention order, had his cases continued to Nov. 26 for status. Because the cases are so old, motions being filed must be heard by the judges who sat at the time Roche was charged.

Lonell Rodgers, 27, of 2A Dennis Drive, charged Oct. 28 with driving under the influence of alcohol, driving without a license and driving outside lanes, had his case continued to Nov. 19.

James Russell, 48, of 11A Folger Ave., charged Oct. 29 with driving with a suspended license, not possessing a license and improper driving, had his case continued to Nov. 5.

Sorasak Santikulanont, 35, of Nantucket, charged March 14, 2004 with driving under the influence of alcohol, admitted to violating his probation and had the probation terminated.

Robert M. Scribner, 26, of 14 Cedar Circle, charged Jan. 6 with disorderly conduct, paid due costs and had the case dismissed. His Jan. 10 charge of drug possession was continued to Nov. 26 for payments.

Michael J. Siebold, 20, of Haworth, N.J., charged July 29 with drug possession and being a minor possessing alcohol, paid due costs and had his case dismissed.

Geoffrey J. Smith, 30, of 10 New Lane, charged Oct. 25 with driving with a suspended license, will have the charge dismissed with $50 court costs.

Adam M. Spencer, 17, of 3 Deer Run Road, charged with six counts of breaking and entering a boat/vehicle to commit a felony on July 15 and July 17, larceny under $250 on July 17, six counts of larceny over $250 on July 15, larceny of a firearm and three counts of malicious destruction of property, had all his cases continued to Dec. 10.

Kevin Stanton, 18, of 20 Somerset Road, charged July 23 with drug possession, paid due costs and had his case dismissed.

Parker N. Swift, 26, of Boston, Mass., charged July 2 with driving under the influence of alcohol, negligent driving, driving outside lanes and speeding, had his case continued to Dec. 10.

Nigel J. Timms, 49, of Texas, charged Sept. 1 with driving under the influence of alcohol, driving outside lanes and not wearing a seat belt, had his case continued to Nov. 13.

Timothy A. Trudel, 22, of 11 Mizzenmast Road, charged Oct. 13 with driving under the influence of alcohol, with an open container of alcohol and outside marked lanes, had his case continued to Nov. 13.

Brett T. Watts, 24, of 4 Althea Lane, charged Dec. 9, 2006 with cocaine distribution and conspiracy to violate the drug law, had his case continued to Nov. 13.

Mark R. Whitcomb, 48, of Nantucket, charged Aug. 29, 2005 with driving with a suspended license and drug possession, and probation violation stemming from Aug. 7, 2006 charges of breaking and entering to commit a felony and larceny under $250, had his cases continued to Nov. 5.

Kenneth E. White, 49, of Sandwich, Mass., charged March 31 with drug possession with intent to distribute, had his case continued to Nov. 13. A motion to suppress evidence in the case was denied.

Fred E. Wilson, 38, of 3B Cynthia Lane, charged Sept. 20 with drug possession with intent to distribute, driving with a suspended license and a lights violation, had his case continued to Dec. 17.
