Nantucket Court Report
In one of the longest, single day dockets in the history of Nantucket District Court, on Monday cases for 83 people were heard during the session. Many of the cases were old and most of the charges involved driving while intoxicated, assault and battery and drugs.

A warrant was to issue for Robert M. Agnew, 30, of 14A Essex Road, charged July 27, 2006 with drug distribution.

Richard W. Anderson, 23, of 13 Deer Run Road, charged Aug. 8 with driving under the influence of alcohol, driving outside lanes and with no license in possession, had his case continued to Nov. 13 for a trial date.

Sandra Beirute-Araujo, 48, of 4 Luff Road, charged July 14 with assault and battery, was placed on pre-trial probation for six months and must attend anger management counseling.

Marvin S. Bryan, 31, of 9 Somerset Road, charged Sept. 6 with assault and battery, had his case continued to Oct. 15.

A warrant was to issue for Edwin W. Callejas, 37, of 114 Washington Street Extension, charged Sept. 7 with drug possession, subsequent offense, driving with a suspended license and equipment violations.

Antelmo D. Mendoza Calmo, 30, of 27 Evergreen Way, charged June 30 with driving under the influence of alcohol, driving without a license and driving outside lanes, admitted to the intoxicated driving charge and had that charge continued one year without a finding. He must attend driver alcohol education and had his license suspended for 45 days. Driving without a license was dismissed and he was found not responsible on the lanes charge.

Jack K. Cartwright, 35, of 48 Essex Road, charged September 2006 with two counts of cocaine distribution and conspiracy to violate the drug law, had his case continued to Sept. 24 for status review.

Umar Chaudhry, 21, of Weymouth, Mass., charged Aug. 29 with drug possession with intent to distribute, had his case continued to Oct. 15.

Christina Ciarmataro, 18, of 28 Equator Drive, charged Aug. 1 with driving under the influence of alcohol and driving outside lanes, had her case continued to Nov. 13 for a trial date.

Philip Corby, 36, of 2 Kendrick St., charged Nov. 6, 2006 with assault and battery, had his case dismissed.

James M. Cromartie, 25, of 114 Washington Street Extension, charged Sept. 9 with driving under the influence of alcohol, a lights violation and not wearing a seat belt, had his case continued to Oct. 15.

Stephen J. Fardig, 26, of Smithtown, N.Y., charged May 25 with driving under the influence of alcohol, resisting arrest, driving outside lanes, negligent driving and speeding, was given an Oct. 1 trial date.

Sergio C. Flores, 35, of 2 Cartwright Place, charged May 12 with leaving the scene of property damage, had his case continued to Oct. 15.

Nora Forgacs, 36, of 5 Grove Lane, charged June 18 with driving without a license, paid due costs and had his case dismissed.

Henrique Franca, 25, of 7 Cynthia Lane, charged June 11 with driving under the influence of alcohol, driving outside lanes and not wearing a seat belt, had his case continued to Nov. 26.

Daniel Franklin, 32, of 7 Cynthia Lane, charged Dec. 2006 with cocaine distribution and a drug violation near a school and on Feb. 10 with driving with a suspended license, having no inspection sticker and not wearing a seat belt, had both cases continued to Oct. 22 for status review.

Mark J. Freeman, 30, of 18 Boynton Lane, charged June 18 with disorderly conduct, trespassing and larceny under $250, had his case continued to Oct. 15.

Christopher E. Gatto, 29, of Needham, Mass., charged June 2 with driving under the influence of alcohol, was given an Oct. 2 trial date.

Eric Gilston, 19, of Greenland, N.H., charged Aug. 10 with driving under the influence of alcohol, negligent driving and driving outside lanes, had his case continued to Oct. 29.

Joshua Gohring, 23, of Attleboro, Mass., charged Sept. 8 with driving with a suspended license, driving with no inspection sticker and a license plate violation, had his case continued to Oct. 15.

Gary Gomez, 26, of 3 Cartwright Place, charged July 14 with driving under the influence of alcohol and driving outside lanes, was given an Oct. 1 trial date.

Glenn R. Halliday, 44, of 28 Kildeer Lane, charged Aug. 21 with driving under the influence of alcohol and driving outside lanes, had his case continued to Oct. 9.

Kimberly S. Hardy, 24, of 37 Tashama Lane, charged Sept. 6 with driving under the influence of alcohol and a license plate violation, had her case continued to Oct. 9.

Probation violations were withdrawn against

Edwar M. Hawkins, 23, of Nantucket, charged Aug. 19, 2006 with resisting arrest and drug possession and on Nov. 26, 2005 with receiving stolen property valued over $250.

Kevin D. Holdgate, 35, of 50 Old South Road, charged Sept. 7, 2006 with cocaine distribution and conspiracy to violate the drug law, had his case continued to Oct. 9 for status review.

Ryan C. Jepson, 25, of 55 Pleasant St., charged June 2 with driving an uninsured vehicle with a sus- pended registration and missing registration sticker, had the uninsured charge continued without a finding for six months and was assessed $200 court costs. He was found responsible for the suspended registration and not responsible on the sticker charge.

Lyneathia D. Jones, 42, of 30A Norwood St., charged May 15 with larceny from a building, had her case continued to Dec. 10 for payment review.

Theo B. Jordan, 23, of Duxbury, Mass., charged June 8 with driving under the influence of alcohol and outside lanes, was given an Oct. 3 trial date.

Sean P. Joslin, 40, of 7 Brinda Lane, charged Dec. 28, 2006 with assault and battery, had his case continued to Nov. 13 for a trial date.

Steven Jube, 51, of Nantucket, charged April 18 with driving with a suspended license and failing to identify himself or stop at an intersection, and charged Jan. 9, 2001 with driving under the influence of alcohol, had both cases continued to Oct. 9 for motions hearings.

Jonathan G. Kelly, 27, of 12 Macy Lane, charged Jan. 20 with driving under the influence of alcohol and driving outside lanes, was given an Oct. 2 trial date.

Edward W. Kidon, 41, of 8 Daffodil Lane, charged Oct. 20, 2005 with driving under the influence of alcohol without a license, had his probation terminated.

Michael A. Kittila, 18, of 8 Pine Grove Lane, charged April 10 with assault with a dangerous weapon and on Dec. 13, 2006 with seven counts of breaking and entering in the day to commit a felony, three counts of vandalizing property, two counts of vehicle larceny, two counts of using a vehicle without authorization and four counts of larceny over $250, had all his cases continued to Dec. 4 for trial.

Kevin Konetchy, 22, of 31 Appleton Road, charged Aug. 5 with driving under the influence of alcohol, negligent driving and failure to slow at an intersection, had his case continued to Oct. 22 for status review.

George F. Korn, 68, of 14 Pleasant St., charged Oct. 3, 2006 with driving under the influence of alcohol and failing to stop or yield, was given an Oct. 3 trial date.

Meredith E. Laine, 35, of Norwell, Mass., charged July 8 with driving under the influence of alcohol and a bylaw violation, had her case continued to Oct. 9.

Daniel A. Landaverde-Manci, 32, of 18A Bailey Road, charged Sept. 1 with driving under the influence of alcohol, a lights violation and speeding, had his case continued to Oct. 15.

Sandrine M. Legrand, 31, of 71 Milestone Road, charged Aug. 10, 2006 with driving under the influence of alcohol, paid due costs and had the case dismissed.

Michael M. Lindley, 25, of 4 Morgan Square, charged Aug. 4 with driving under the influence of alcohol and driving outside lanes, had his case continued to Nov. 13 for a trial date.

Emil P. Malfati, 28, of 12 Celtic Drive, charged Sept. 1 with assault and battery, had the charge dismissed.

Silviya Malfati, 23, of 12 Celtic Drive, charged Sept. 1 with assault and battery, had the charge dismissed.

Evan D. Marley, 39, of 5 Eagle Way, charged Jan. 6 with driving under the influence of alcohol, third offense, failing to stop and speeding, was given a Dec. 3 trial date.

William J. McCarthy, 52, of 7A Forest Ave., charged May 26 with driving under the influence of alcohol and speeding, had his case continued to Nov. 13 for a trial date.

Reginald D. Miller, 17, of 17 Correia Lane, charged April 3 with trespassing and intimidating a witness, was placed on pre-trial probation for one year.

Hidelfonso O. Monzon, 35, of 19 Cynthia Lane, charged Aug. 26 with driving under the influence of alcohol, driving outside of lanes and not wearing a seat belt, had his case continued to Oct. 15.

Joshua Moore, 22, of 17A Essex Road, charged June 8, 2006 with driving under the influence of alcohol, on July 25, 2006 with assault and battery and on Aug. 4, 2006 with violating a restraining order, will have a court payment review Dec. 10 on the intoxicated driving charge and had the other charges dismissed.

Seth R. Moyer, 31, of 23 Broadway, charged July 2 with driving under the influence of alcohol, had his case continued to Nov. 13 for a trial date.

Duilio Neto, 23, of Fall River, Mass., charged Sept. 9 with receiving stolen property valued at more than $250, had his case continued to Nov. 26.

Stoil G. Nikolov, 30, of 12 Celtic Drive, charged Sept. 1 with assault and battery, had the charge dismissed.

Elizabeth A. Obremski, 23, of 4 Wamasquid Place, charged Aug. 5, 2006 with driving under the influence of alcohol, had her charge dismissed.

James O'Brien, 25, of 25 Nobadeer Farm Road, charged Aug. 9 with disorderly conduct, paid due costs and had his case dismissed.

Cotey W. O'Neill, 21, of 8 Mary Ann Drive, charged July 22 with unarmed burglary, two counts of assault and battery and disorderly conduct, had his case continued to Oct. 9.

Maurice G. Ortiz, 26, of 47 Appleton Road, charged May 20 with driving with a suspended license, paid due costs and had his case dismissed.

Kyle W. Paterson, 20, of Falmouth, Mass., charged Jan. 19 with drug possession, driving with a suspended license, having no license in possession and failing to stop, charged on Jan. 22 with drug possession, charged on March 30 with drug possession, delivering alcohol to a minor and a bylaw violation, charged April 6 with drug possession and again on April 30 with driving under the influence of alcohol, a lights violation and driving with a suspended license, pleaded guilty to the intoxicated driving charge and it was filed. He admitted to possessing what the judge said were small amounts of marijuana on the other dates and had those charges continued concurrently without findings for one year.

Nicholas T. Phillips, 18, of 6B Norquarta Drive, charged Aug. 8 with assault and disorderly conduct, had his case continued to Oct. 22 for status and motions hearings.

Joan E. Reid, 51, of 16B Waydale Road, charged July 1 with driving an uninsured vehicle, paid due costs and had her case dismissed.

Mark T. Reid, 43, of Nantucket, charged Oct. 21, 2006 with driving under the influence of alcohol and on June 5 with driving under the influence of alcohol, driving outside lanes and not wearing a seat belt, had his cases continued to Nov. 13 for a trial date.

Kennedy P. Richardson, 21, of 25 Low Beach Road, charged June 16 with driving under the influence of alcohol and driving outside lanes, had his case continued to Nov. 13 for a trial date.

Joshua M. Rivers, 19, of 30 Dukes Road, charged July 22 with unarmed burglary, two counts of assault and battery and disorderly conduct, had his case continued to Oct. 9.

Tereso Rodriguez-Valencia, 31, of 13 Cedar Circle, charged Sept. 4 with driving without a license and driving a vehicle unregistered in the state after 30 days, will have the license charge dismissed with $100 court costs and was found not responsible for failing to register a vehicle.

Manuel Rojas, 39, of 20 West York Lane, charged Dec. 14, 2006 with driving under the influence of alcohol and with a suspended license, a lights violation, driving an unregistered vehicle, not wearing a seat belt and making an improper turn, had his case continued to Nov. 13 for a trial date.

Edwin Ruiz, 35, of 4 Hull Lane, charged May 29 with being a landlord interfering with a tenant's quiet enjoyment, paid due costs and had the case dismissed.

Janet Ruttenberg, 20, of Newton, Mass., charged Aug. 26, 2006 with several counts of drug possession, had the case dismissed.

Antolin Sanchez-Guerrero, 36, of Bailey Road, charged Sept. 2 with driving without a license, a license plate violation and not wearing a seat belt, will have the license charge dismissed with $100 court costs and was found not responsible on the other charges.

Sorasak Santikulanont, 35, of 17 Miacomet Ave., charged in August, September and October 2006 with drug distribution and conspiracy to violate the drug law near a school, as well as being charged March 14, 2004 with driving under the influence of alcohol, will be arraigned in Superior Court on Sept. 24.

Thomas M. Scannell, 21, of 5 Mizzenmast, charged June 14 with disorderly conduct, driving under the influence of alcohol, leaving the scene of property damage, driving outside lanes, speeding and driving an unregistered vehicle, had his case continued to Oct. 9.

Grant R. Scheibel, 48, of Nantucket, charged Sept. 10 with assault and battery, had his case continued to Oct. 22 with an order to stay away from his alleged victim.

Chas Sexton, 17, of Centerville, Mass., charged May 20 with aggravated assault and battery, had his case continued to Nov. 13 for a trial date.

James W. Simmons, 26, of 35 South Shore Road, charged June 13 with driving under the influence of alcohol, improper driving and not wearing a seat belt, and on July 20 with driving with a suspended license, had his cases continued to Nov. 13 for a trial date.

Robert Souza, 44, of 11 Union St., charged Aug. 2, 2006 with cocaine distribution, had his case continued to Oct. 9 for a motion hearing.

Adam M. Stiener, 40, of Winston-Salem, N.C., charged July 26 with driving under the influence of alcohol and drug possession, had his case continued to Nov. 13 for a trial date.

Courtney A. Stock, 20, of Newton, Mass., charged July 15 with driving under the influence of alcohol, leaving the scene of property damage and drug possession, had her case continued to Nov. 13 for a trial date.

Parker N. Swift, 26, of Boston, Mass., charged July 2 with driving under the influence of alcohol, negligent driving, driving outside lanes and speeding, had the intoxicated driving charge amended to serious bodily injury and the case was continued to Oct. 9.

Peter Takac, 34, of 17A Gray Ave., charged May 29 with driving under the influence of alcohol, driving outside lanes and not wearing a seat belt, had his case continued to Nov. 13 for a trial date.

Joel B. Walbridge, 28, of 6 Amelia Drive, charged April 3 with driving an uninsured vehicle and speeding, will have the insurance charge dismissed with $100 court costs and was found not responsible for speeding.

Curt G. Watkins, 37, of Ft. Lauderdale, Fla., charged Aug. 15 with assault and battery, had his case dismissed.

Brett T. Watts, 24, of 4 Althea Lane, charged Dec. 9, 2006 with cocaine distribution and conspiracy to violate the drug law, had his case continued to Oct. 9.

Adeane K. Watty, 18, of 6B Benjamin Drive, charged Aug. 8 with assault and battery on a police officer, disorderly conduct and resisting arrest, had his case continued to Oct. 22 for status review and motions hearings.

William A. Weinborg, 21, of Hamburg, N.Y., charged April 17 with driving under the influence of alcohol, negligent driving and driving outside lanes, had his case continued to Nov. 13 for a trial date.

Tyrone Williams, 29, of Larrabee Lane, charged Nov. 16, 2006 with two counts of cocaine distribution and a drug violation near a school, is in federal custody and is being deported, so his charge was filed without a change of plea to be dealt with if he reenters the country.

Joshua R. Wills, 26, of Newport Beach, Calif., charged Aug. 27, 2006 with driving under the influence of alcohol, had his probation violation extended to Nov. 19 for review.

Donald Wuerl, 28, of Peachtree City, Ga., charged Aug. 23, 2006 with driving under the influence

of alcohol, had his case continued to Oct. 15. I
