I ON THE COURT Nantucket Court Report Monday marked the start of the District Court winter six-man jury session with one trial for John W. Breshnahan, 47, of Northampton, Mass., set for the start of jury selection that afternoon. Breshnahan is charged with driving under the influence of alcohol. Other trials which may occur throughout the week include a case against Carrie E. Bianchi, 30, of 111 Hummock Pond Road, who is charged with driving under the influence of alcohol. The case against Walter J. Burnham, 49, of Wilbraham, Mass., was continued to the April trial session. He was charged June 23 with driving under the influence of alcohol. David J. Carpenter's case was also continued to April. Carpenter, 51, of 36 Chuck Hollow Road, is charged with violating a restraining order. Evan S. Carr, 25, of 21B Essex Road, had a Jan. 29 charge of driving under the influence of alcohol dismissed. He admitted to negligent driving and had that charge continued one year without a finding, during which time he must take the driver alcohol program. He was found responsible for not wearing a seat belt and not responsible for failing to signal a turn. Denise M. Corson, 27, of 74 Egan Lane, will have Dec. 4 charge of driving without a license dismissed with $250 court costs. She was found responsible for driving outside marked lanes. Clinton F. Davidson was to have a jury trial on charges of assault and battery and using a vehicle without permission but the witness did not appear at court and both charges were dismissed. Porfirio O. Del Rosario will have a charge of driving without a license dismissed with $250 court costs. He was found not responsible for failing to wear a seat belt. Weverton L. Deoliveira, 32, of Brazil, had a Nov. 30 charge of driving with a suspended license continued one year without a finding and was found responsible for an equipment violation. David B. Edgar, 33, admitted to driving under the influence of alcohol on May 24 and had the case continued one year without a finding. He must take the driver alcohol program and had his license suspended for 45 days. He was found not responsible for driving outside marked lanes. A case against Eric S. Engelsen was continued to yesterday. He is charged with two counts of larceny by check over $250. Mariana Faria, 26, admitted to driving under the influence of alcohol on Oct. 28 and had the case continued one year without a finding. She must take the driver alcohol program and had her license suspended for 45 days. She was found responsible for speeding but not for failing to wear a seat belt or failing to have an inspection sticker. Karen S. Frazier, 48, of Vermont, will have a Dec. 2 charge of shoplifting dismissed with $100 court costs. Stephen Gordon, 27, of Jamaica, will have a charge of driving without a license dismissed with $200 court costs and was found not responsible for driving outside marked lanes and a bylaw violation. Veneice Gordon, 31, of Jamaica, will have a charge of driving without insurance dismissed with $200 court costs and was found not responsible for driving without a registration. Orville T. Grant, 44, of 4 West Creek Road, admitted to driving under the influence of alcohol on May 25 and had the case continued one year without a finding. He must take the driver alcohol program and had his license suspended for 45 days. He was found not responsible for speeding and driving outside marked lanes. Dominic N. Hall, 24, of 22 Mizzenmast, paid all fees from his May 27 charge of marijuana possession and had the case dismissed. Richard K. Henry, 56, of 7 Goldfinch Drive, had a case involving driving under the influence of alcohol, and Nov. 26 charges of assault and battery and threatening to commit a crime continued to Feb. 5. John Hilmer, 23, of 20 Appleton Road, had a Dec. 1 charge of driving under the influennce of alcohol continued to Jan. 8. Jakub M. Juscynski, 29, had a March 25 charge of driving under the influence of alcohol dismissed. He was found guilty of negligent driving and leaving the scene after property damage and was placed on probation for one year. A guilty finding for driving with a suspended license was filed. He was found not responsible for speeding and marked lanes violations. The case against George F. Korn, charged with driving under the influence of alcohol, was continued to June 4. The case against Douglas W. Lange, charged with driving under the influence of alcohol, was continued to Jan. 16. Tyrone G. McLaughlin, 31, of 5A Cow Pond Lane, had a Nov. 13 charge of assault and battery dismissed. Jemima R. Moore, of Nantucket, will have a Nov. 20 charge of driving with a suspended license dismissed with $50 court costs. She was found not responsible for a bylaw violation. Larry Mote, 51, formerly of Nantucket, had a Nov. 4, 2004 charge of drug possession dismissed. Amotions hearing to suppress evidence was set for Jan. 22 regarding his Oct. 11 charge of drug possession. A trial is expected in this session on another drug possession charge from 2005. James M. Steere, 47, of California, paid due costs and had his June 1 drug possession charges dismissed. Martin E. Stone, 64, of 38 Hooper Farm Road, paid due costs and had his March 22 charge of negligent driving dismissed. Jonathan M. Symer, 24, of 82 Hummock Pond Road, had his July 25 charge of assault and battery continued to Feb. 5. Eduardo Tejada, 30, of 115 Hummock Pond Road, had his Sept. 29 charge of assault and battery with a dangerous weapon dismissed. Roberto Tejada, 22, of 52 Cato Lane, who was in custody Monday, will have a bail review hearing in the Barnstable Superior Court on his $25,000 bail in an Oct. 8 case charging him with assault and battery with a dangerous weapon (a vehicle). It is alleged that he attempted to hit someone in the Muse parking lot but missed that person and struck three others. There are several other charges in that case, which was continued to Jan. 8.
