DISTRICT ATTORNEY'S OFFICE CLARIFIES PURPOSE OF JANUARY TOOLAN HEARING On Nov. 27 and 28, motions hearings were held in Barnstable Superior Court in the case against Thomas Toolan III, accused of murdering Elizabeth "Beth" Lochtefeld on Oct. 25, 2004. Toolan's attorney presented seven defense motions, of which six sought to suppress evidence and one, not heard, was to change the trial venue from Nantucket to another county.

Judge Richard Connon, who is assigned to the case, took the motions under advisement and scheduled another hearing on Jan. 19 in Barnstable. According to First Assistant District Attorney Brian Glenny, that hearing is not just to review the case's status, it is also for assignment of a trial date.

Glenny said he believes he and Toolan's lawyer Kevin Reddington should be able to decide on a trial date at that time provided the judge has ruled by then on the motions to suppress and depending on whether either side chooses to appeal any of his decisions. Appeals must be done before the trial is set.

Glenny also clarified action Reddington took regarding a motion to suppress evidence. One related to computers seized in his Manhattan apartment and at Ms. Lochtefeld's Hawthorne Lane cottage where the murder occurred. Reddington withdrew a portion of that motion dealing with Ms. Lochtefeld's computer because Toolan had no rights to privacy or possession of that equipment; however the rest of the motion involving the computer at his apartment still stands.

Glenny previously said that Judge Connon did not hear the petition to change the trial venue because it is believed that he wants to wait until a jury is being chosen on Nantucket to see whether Toolan's right to a fair trial is prejudiced, as is asserted in Reddington's motion.

U.S COAST GUARD AUXILLARY, NANTUCKET, ELECTS NEW OFFICERS At the U.S Coast Guard Auxillary Flotilla 11-7 Nantcket elections

Carl England was elected Flotilla Commander, succeeding Kiril Coonley. Harry Tipper was elected new Vice Flotilla Commander. Presiding over the election was rear commodore Carolyn Belmore of the Southeast New England District.

The U.S.C.G. Auxillary will be offering a variety of boating safety courses this coming spring, starting with basic boating, paddle safe and GPS courses. These courses are designed to make boating more fun and avoid the many disasters that can happen on the water.

LET THERE BE LIGHTS Nantucket Visitor Services and The Nantucket Island Chamber of Commerce announce the first Nantucket Island Christmas lights decorating contest open to all residences.

Beginning Monday, December 4, interested participants can pick up registration forms at the Visitor Services office at 25 Federal Street or the Chamber of Commerce office upstairs at 48 Main Street. The deadline for registering will be Monday, December 18, 2006. Judging will only be for home exteriors in the following categories: • Brightest Lights • Most Traditional • Most Creative

• Best Nantucket Holiday Spirit.

Judging will be Friday, December 22 and the winners will be announced at the Chamber's Red Ticket Holiday Drawing on Sunday, December 24. Photographs of the winning residences will be published in the local newspapers. A listing of participating homes will be available to the public at Visitor Services and the Chamber.
